They Just Won't Go Away
 
The Shooting Wire reported this morning the Center for Biogical Diversity, the American Bird Conservancy, and other groups that brought the petition to the EPA seeking to ban lead in firearms ammunition are not giving up. The groups plan to challenge the ruling by the EPA that lead in ammunition is beyond their authority. They have submitted a Freedom of Information Act Request requesting all documents related to the decision.

In a press release sent out by CBD , they say:

“The Environmental Protection Agency’s denial was based on false assumptions and an inexplicable misreading of so-called exemptions in the Act,” said Adam Keats, senior counsel for the Center for Biological Diversity. “Given the EPA’s clear authority and duty under the Toxic Substances Control Act to regulate toxic lead in ammunition to end unnecessary lead poisoning of wildlife and reduce human health risk, it appears that their decision to dodge the issue was politically motivated.”
Later in the press release, they add:

“We are going to get to the bottom of the politics behind the EPA decision — we are not going to let the agency simply walk away from the preventable poisoning of birds and other wildlife,” said Jeff Miller, conservation advocate with the Center. “We remain committed to making sure toxic lead is removed from the environment, and we’re continuing our campaign to see that through.”
The American Bird Conservancy is similarly upset. In their press release, they say the EPA made a wrong decision and that electoral politics were involved. According to Darin Schroeder, their VP for "conservation advocacy":

The EPA erred, either purposely or by not reading the applicable laws we cited in our extensive, well-researched petition, in their rush to dismiss the hunting ammunition portion of our complaint before the November elections.
They want a meeting with Steve Owens, the EPA Assistant Administrator, to get answers. So far he has blown them off and they are mad.

it is the obligation of the Administration to accept its legal responsibility and affirmatively act on this issue within 90 days time. Without question, we are looking at all options for recourse
The late political scientist Harold Lasswell long ago defined politics as who gets what, when, and how. These so-called environmental groups knew they couldn't ban hunting or lead ammunition if they went the legislative route. When their backdoor attempt to do the same was ultimately stopped (so far), then, and only then, did they begin to cry "politics".

It was politics from the moment they filed their petition and they know it. If some Obama political appointee at EPA stopped this because he knew it would make a bad November even worse for the Democrats, tough. If your erstwhile allies are telling you to knock it off, you might want to listen. However, when it comes to true believers, you just can't tell them no and have them listen.

Grew up in Jersey.

Spent 3 months of summer in Long Island, NY each year.  (It still oddly enough feels like the "true" beach to me.)

I stopped living there when I was 17 because I went to college in the South.  I will never move back because of their nannified pantie waste attitude about EVERYTHING.  It's not just guns.  It's everything.  You can't even work on your own home.  Permits to fix or improve something is a nightmare and that you have to hire some bully union worker because government agents literally cruise the streets checking for people, God forbid, using a hammer or a shovel.

My father is going to retire this year (although I am sure he will keep working somewhere.)  My folks are moving south as well.  My father works executive protection for a CFO of a large corporation.  Jersey granted him a carry permit after obtaining work place attestations of need, multiple character references, the sheriff's signature and the local magistrates signature, all who had a power to deny for no reason.  His permit is only good in defense of his client while working.  Not for himself.  HOW CRAZY ?  New York wouldn't give him one.  No comment on that but he spends most of his time in New York.  Aerosmith comes to town ?  They get permits. P Diddy ? Permit.

A couple years ago a Navy Seal was facing charges for shooting an intruder in his own home in his child's bedroom with a Beretta that he was not permitted to have.

It's unAmerican.

ETA: Hard to believe that Creedmore NY in Long Island was once synonamous with Rifleman.  ANd that New York gave the NRA the money to buy the land.  Now it is no longer.

I know each state is different,but in Ky.the only punishment for carrying in a public store is they can ask you to leave.If it is concealed how do they know?Of course government buildings are off limits.Now back to the subject Walmart allows concealed carry in Ky.But I will be the first to agree we should boycott anyone that is anti 2A.

In Florida and most other states you can defend your property with force, but not deadly force (An exception in my state being theft of weapons). The author assumes deadly force is reasonable force to protect property... which don't agree with. Reasonableness is pretty clearly defined in US law, and I have my doubts about whether most prudent people will find it reasonable to shoot someone for taking their things.

That being said, the author is flat wrong about what the issue presented is. A man fired shots into his lawn to deter a large number of other men from what they threatened to do. If an apparent gang/mob of significantly larger number shouting death threats doesn't qualify as imminent danger then I don't know what does. Not knowing New York law, I don't know what the state would charge Mr. Grier with, but warning shots are generally a bad idea.

Hoping this man's lawyer does him well in front of a jury.

I deer hunted for years with a model 70 Win.Featherweight using the Speer 70 gr.soft point.Don't know twist rate of that rifle probably 1 in 12,it shot 52 gr Sierra BTHP extremely well,but the 70 gr.were barely minute of deer.I shot the barrel out on that rifle and like a fool sold it instead of having it re-barreled.Gun nuts do stupid things sometimes.

One never knows until you try, which is why I said it didn't matter what the twist rate was.

Heavy bullets have been stabalized in slow twists in the past, and I've seen some remarkably accurate results with what you'd guess to be mismatched components.  Not typical of course, but again, you never know until you try.  Strange things happen sometimes.
